These Terms of Service ("Terms") govern your access to and use of myguideinpanama.com (the "Site") and any tour, transport, or guiding service you book with My Guide In Panama ("we," "us," "our", "the Company"). By using the Site or booking a tour, you agree to these Terms. If you do not agree, please do not use the Site or our services.

1. About the service

My Guide In Panama provides guided day tours, transport, and travel-planning assistance in and around Panama City, Panama. Tours are described on the Site for general information only; exact itineraries, timing, pricing, and availability are confirmed directly with you by phone, email, or WhatsApp before booking.

2. Eligibility

By using this Site or booking a tour, you confirm that you are at least 18 years old, or are using the Site with the involvement of a parent or guardian, and that you have the legal capacity to enter into a binding agreement.

3. Bookings and inquiries

Submitting a contact or booking form is an inquiry, not a confirmed reservation. A booking is only confirmed once we have communicated availability, price, and details directly to you and received any required confirmation or deposit. We reserve the right to accept or decline any booking request.

4. Pricing and payment

Prices quoted are in the currency stated at the time of quotation and may change without notice until a booking is confirmed. Accepted payment methods, deposit requirements, and cancellation-related charges (if any) will be communicated to you directly at the time of booking.

5. Cancellations and changes

Cancellation and rescheduling terms (including any applicable notice periods or fees) will be provided at the time of booking. Weather, safety conditions, park or site closures, or circumstances beyond our control may require us to modify, postpone, or cancel a tour; in such cases we will make reasonable efforts to offer a suitable alternative date or, where appropriate, a refund of amounts paid for services not rendered.

6. Your responsibilities

When participating in a tour, you agree to:

• Arrive on time at the agreed pickup point and time.
• Follow the reasonable safety instructions of your guide.
• Disclose any medical conditions, mobility limitations, or allergies relevant to the tour in advance.
• Behave respectfully toward guides, drivers, other guests, and local communities.
• Hold any travel insurance, visas, or documentation required for your trip to Panama.

We reserve the right to remove any participant from a tour, without refund, whose conduct endangers themselves, other guests, staff, or wildlife/property.

7. Assumption of risk

Outdoor and travel activities, including boat transport, jungle or trail walking, and wildlife viewing, carry inherent risks. To the fullest extent permitted by applicable law, you participate in tours at your own risk, and you are responsible for assessing your own fitness and suitability for a given activity.

8. Limitation of liability

To the fullest extent permitted by applicable law, My Guide In Panama, its guides, drivers, and affiliated partners are not liable for any indirect, incidental, or consequential damages arising from your use of the Site or participation in a tour, including but not limited to lost time, missed connections, or personal property loss, except where such liability cannot be excluded by law (for example, in cases of death or personal injury caused by proven negligence). Nothing in these Terms limits any liability that cannot lawfully be limited under the laws of Panama or your country of residence.

9. Third-party services

Some tours may involve third-party operators, drivers, boat captains, or venues. We select partners carefully, but we are not liable for acts or omissions of independent third parties outside our direct control, beyond what applicable law requires.

10. Intellectual property

The text, images, logos, and design of this Site are owned by or licensed to My Guide In Panama and may not be copied, reproduced, or used for commercial purposes without our prior written permission.

11. Site use

You agree not to:

• Use the Site for any unlawful purpose.
• Attempt to gain unauthorized access to the Site, its admin systems, or related accounts.
• Interfere with the normal operation of the Site (for example, through automated scraping or attacks).
• Submit false, misleading, or fraudulent information through our forms.

12. Reviews and communications

If you leave a review or testimonial, you grant us permission to display it on the Site or in our marketing materials, with attribution as appropriate, unless you request otherwise.

13. Governing law

These Terms are governed by the laws of the Republic of Panama, without regard to its conflict-of-law principles, except where mandatory consumer-protection laws of your country of residence provide otherwise. Any dispute arising from these Terms or your use of the Site shall be subject to the non-exclusive jurisdiction of the competent courts of Panama, without prejudice to any right you may have to bring proceedings in your home jurisdiction under applicable consumer law.

15. Severability
